Alabama Child Predator Death Penalty Act 2026
The state of Alabama has introduced one of the toughest laws in the United States to combat child sexual abuse. Governor Kay Ivey signed the Child Predator Death Penalty Act (HB41) on February 12, 2026, allowing the death penalty for severe crimes against children under 12.
The law was passed following a disturbing 2025 case in Bibb County, where multiple individuals were charged with trafficking, rape, and sexual torture of young children. The case created public outrage and pushed lawmakers to act swiftly.
Under the new law, first-degree rape, first-degree sodomy, and sexual torture of minors can now be treated as capital offenses. The bill received strong support in the state legislature and will take effect on October 1, 2026.
However, the law is expected to face legal challenges due to the U.S. Supreme Court ruling in Kennedy v. Louisiana, which previously barred the death penalty for child rape when the victim does not die.
Despite the controversy, Alabama’s move has reignited a national debate on stricter punishments for crimes against children.
